Welcome to Product Idea Kit at productideakit.com (the "Service"), owned and operated by Felipe Suarez ("Company", "we", "us", "our"). By using the Service, creating an account or buying a subscription, you ("you", "your") agree to these Terms and Conditions ("Terms"). If you don't agree, don't use the Service.

1. What the Service is

Product Idea Kit is a software tool. It suggests digital product ideas (ebooks, lead magnets, printable guides) based on a topic you enter, shows search data from third-party sources, can review an idea with a structured validation method, and writes prompts you can use in an AI tool to create the product, sales page and ads.

2. Age and eligibility

You must be at least 18 years old and able to enter a binding contract to use the Service.

3. Accounts

You sign in with a link sent to your email. You agree to:

  • Use an email address you control, and keep access to it secure.
  • Not share your account with others.
  • Accept responsibility for activity under your account.

4. Plans and allowances

  • Creating an account is free, but idea searches and validations need a paid plan. You can see a sample result without an account.
  • Each paid plan includes a monthly allowance of idea searches and validations, shown on the pricing page: Builder includes 15 idea searches and 10 validations a month, and Pro includes 40 idea searches and 30 validations a month.
  • Paid allowances reset each billing period and don't roll over. They are not credits, have no cash value and can't be transferred.
  • A search or validation that fails is returned to your allowance.
  • We may set fair-use limits (for example, searches per day) to keep the Service working for everyone.

5. Payments

  • Prices are in U.S. dollars unless stated otherwise.
  • Payments are processed by Blink (Blink Global LLC), our merchant of record, which handles payments, invoicing, sales tax and refunds. Your use of Blink's checkout and customer portal is also governed by Blink's own terms and policies.
  • Subscriptions renew automatically each month until you cancel. You can cancel at any time; your plan stays active until the end of the paid period.

6. Refunds

Refunds are covered by our Refund Policy.

7. Your content and the generated output

  • Your inputs (topics, niches, answers to the seller questions) stay yours. We use them only to run the Service for you.
  • The output (ideas, validation reports, prompts) is yours to use, including commercially, subject to these Terms and the terms of the AI and data providers we use.
  • AI-generated content can be wrong. Output is generated automatically and may contain mistakes, outdated information, or content that's similar to what others receive. Check it before you publish or sell anything based on it. This matters most for health, finance, legal and safety topics, where you should have a qualified professional review the content.
  • Search volumes come from third-party data sources and are estimates. They can change and may not match other tools.

8. Acceptable use

You agree not to:

  • Use the Service for illegal, harmful or deceptive products (for example weapons, drugs, self-harm, explicit content, or products that make false health or income claims).
  • Try to extract, copy or reverse-engineer the Service's system prompts, validation method or scoring.
  • Resell or share access to the Service, or use automated tools to run searches at scale.
  • Interfere with the Service's security or other users' accounts.

We may refuse a search that falls into a blocked category.

9. Intellectual property

The Service, including its software, design, validation method, prompts and text, belongs to Felipe Suarez and is protected by copyright and other laws. These Terms give you a limited, personal, non-transferable right to use the Service while your account is active.

10. No guaranteed results

  • The Service gives information and suggestions for educational and general business purposes. It is not legal, tax, financial or professional advice.
  • We make no promise about sales, earnings, audience growth or any other result from products you create with the Service.
  • Your results depend on your own work, skills, market, and many factors we don't control. You're responsible for your business decisions.

11. Suspension and termination

We may suspend or close your account, without notice, if you break these Terms, misuse the Service, or use it for unlawful or fraudulent purposes. If we close your account for a breach of these Terms, no refund is due. You can stop using the Service and delete your account at any time.

12. Third-party services

The Service relies on third parties, including Supabase (database and sign-in), Google (Gemini AI models), a search data provider (search data), Amazon Web Services (email), Vercel (hosting) and Blink (payments). We're not responsible for their content, policies or availability.

13. Privacy

Our Privacy Policy explains how we handle your information.

14. Disclaimer of warranties and limitation of liability

  • The Service is provided "as is" and "as available", without warranties of any kind, express or implied.
  • To the fullest extent the law allows, Felipe Suarez is not liable for any indirect, incidental, consequential, special or punitive damages arising from your use of, or inability to use, the Service. Total liability is limited to the amount you paid for the Service in the 12 months before the claim.

15. Governing law

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law rules. Disputes go exclusively to the state or federal courts in Florida.

16. Changes

We may update these Terms. Changes take effect when posted here with a new "Last updated" date. If you keep using the Service after a change, you accept the updated Terms.
